Notarial enforcement order in the new legal conditions: theory and notarial, court practice and legislative regulation

The article comprehensively investigates: General problematic issues of perception and application of the notarial enforcement order; General perception of mortgage and related relations when a notary makes enforcement order; General and special conditions for the execution by a notary of an enforcement order on a contract. And also investigated the notarial practice of the notary’s execution of the executive the execution by a notary of the enforcement order, the judicial practice of recognizing the executive notary of the notary such that it is not subject to execution. The problems that arise in this case are identified and options for their solution are proposed by amending the relevant legislation.
