Abstract

The thesis explains the peculiarities of court proceedings and the procedure for the execution of court decisions in cases of compensation for damage caused by the internal affairs bodies of Ukraine.
Specific features of cases on compensation for damage caused by the internal affairs bodies of Ukraine, which are within the subject competence of the courts of Ukraine to consider such cases, are defined.
Using the examples of judicial practice, the peculiarities of determining the method of defense in claims for compensation for damage caused by the internal affairs bodies of Ukraine are analyzed.
It was concluded that not always choosing a claim for damages is a proper way to restore the violated right of the interested person.
In particular, filing a claim for compensation for moral damages in the case of closing a case on an administrative offense is not always an indisputable basis for restoring the violated right.
According to some courts, the victim is obliged to prove the illegal nature of the activities of the employees of the internal affairs bodies in order to receive compensation for moral damage.
There is also another position, which is reflected in court decisions on compensation for damage caused by internal affairs bodies.
According to it, compensation for damage is carried out in case of
closure of the administrative offense case under rehabilitative circumstances – ​the absence of the event or composition of the offense.
Peculiarities of judicial review of disputes about compensation for damage caused as a result of criminal prosecution by the state of the injured person have been studied.
It has been found that the combination of demands for recognition of the activities of the internal affairs bodies of Ukraine in the order of criminal proceedings and civil claims for damages in one proceeding do not find support in the courts.
Judicial practice requires preliminary recognition of the illegality of the criminal-procedural activity of the internal affairs bodies of Ukraine.
But only after such recognition, a claim for compensation for damages is possible.
The peculiarities of the composition of the participants in cases on compensation for damage caused by the internal affairs bodies of Ukraine have been determined. These include the plurality of persons on the defendant’s side. A mandatory condition for this category of cases is the involvement of the State of Ukraine.
The execution of court decisions in cases of compensation for damage caused by internal affairs bodies of Ukraine is entrusted to a special subject – ​the State Treasury Service of Ukraine
